You shall abide by all copyright notices and other restrictions contained in any material accessed through the Site. No material from this Site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. The only exception is that you may download one copy of demo files, or documentation for the purpose of non-commercial information purposes, on condition that you do not edit the copyright or trademark data of this information in any way. None of the intellectual property rights are transferred to you, but remain with VIDCAT.COM the owner of the full and complete intellectual property rights. Use of the materials for any other purpose violates VIDCAT.COM intellectual property rights. The use of any such material on any other Web site or networked computer environment is prohibited.

PURCHASE OF PRODUCTS FROM THIS SITE

The purchase of any products from this Site is governed by the terms and conditions for the use of the products. All digital media is licensed, not sold to the user and cannot be reproduced or redistributed.

RETURNS

DVD's can be returned within 5 days of receipt, only if they have not been opened and still enclosed in shrink-wrap. The only exception is that we will issue a refund or replacement DVD if the customer can prove them to be defective or not usable. Magazines, books, record albums, CDs and all other goods sold on the site are not refundable. In the event that a refund would be issued, the refund will be made in the same manner as the purchase. This will be either by crediting the credit card, Paypal account, or issuing a check (if the purchase was paid for by money order). *Please note: Shipping and handling cannot be refunded, and we will not accept returns of media that has been opened.

ORDER CANCELLATIONS

If you place an order and then change your mind, you can cancel it--but you have to act fast. VIDCAT.COM ships within 24hrs, and many times orders are processed in less than a few hours. If you need to cancel your order send an email to mail@vidcat.com and include your order number. We may be able to cancel your order if you reach us before it ships. If your order has already shipped, you'll have 5 days to return your order, once it arrives. If your order has shipped your credit card or Paypal account will have been charged. You will be issued a refund when the product is returned. *Please note: Shipping and handling can not be refunded, and we will not accept returns of media that has been opened.

ENFORCEABILITY AND TERMINATION OF AGREEMENT

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. VIDCAT.COM may, in its sole discretion, terminate or suspend your access to all or part of this Site for any reason, including, without limitation, failure to comply with any of these Terms & Conditions. Upon termination, you must destroy all materials obtained from this Site and all copies thereof, whether made under the terms of this agreement or otherwise. In the event of termination, you are no longer authorized to access or use this Site, and the restrictions imposed on you with respect to materials downloaded from this Site and the disclaimers and limitations of liabilities set forth in this agreement shall survive.

DISCLAIMER

Your access to and use of this Site is at your sole risk. If you are dissatisfied with any of the materials contained in this Site, or with any of these Terms & Conditions, your sole and exclusive remedy is to discontinue accessing and using this Site.

NO LIABILITY

To the fullest extent permitted by applicable law. VIDCAT.COM shall in no event be liable for any claims, charges, demands, damages, liabilities, losses, or expenses of whatever nature and howsoever arising, including without limitation any compensatory, incidental, direct, indirect, special, punitive, or consequential damages, loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, claims of third parties, or other losses of any kind or character. You assume total responsibility for establishing such procedures for data backup and virus checking as you consider necessary.

You hereby agree to indemnify, defend and hold harmless VIDCAT and the Indemnified Parties from and against any and all claims, charges, demands, damages, liabilities, losses, and expenses of whatever nature and howsoever arising (including but not limited to any legal or other professional fees and the costs of defending or prosecuting any claim and any loss of profit, goodwill, and any other direct or consequential loss) incurred or suffered by VIDCAT and the Indemnified Parties, directly or indirectly, by reason of any act or omission which you commit in breach of these Terms & Conditions (including but not limited to your obligations, representations and warranties contained herein) and any other terms and conditions or policies set forth elsewhere in this Site. You shall cooperate as fully as reasonably required in the defense of any claim. VIDCAT reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
